This is a report prepared by the American Civil Liberties Union on the civil liberties record of Judge Merrick B. Garland. The ACLU does not take a position on Supreme Court nominations as a matter of organizational policy. We have, however, prepared a similar report on every recent Supreme Court nominee in the belief, as also stated in our policy, that “in fulfilling its constitutional role of advice and consent the Senate has an obligation to undertake a thorough examination of a nominee’s views on civil liberties and on the function and role of the judiciary in protecting civil liberties.” It is our hope that this report, which we are also making available to the public, will assist in that effort.
