ACLU Vote Recommendation Urging the House to Vote NO on H.R. 4889, the Kelsey Smith Act

This vote recommendation from the ACLU urges the House to vote “NO” on H.R. 4889, the Kelsey Smith Act. This bill would allow police to require telecommunications providers to turn over the cell phone location information of an individual when officers reasonably believe that person is in an emergency situation that involves the risk of death or serious injury. This change removes a longstanding protection in the law that grants telecommunications providers’ discretion to reject emergency location data disclosure requests made in situations that are not true emergencies.
