Ends the 35-year old sentencing disparity between crack and powder cocaine, which disproportionately impacts Black communities, and applies the changed law retroactively to thousands in federal prison who were sentenced under the racially unjust disparity. The original 100:1 crack to powder disparity was enacted in the 1996 Anti-Drug Abuse Act, and it was reduced to 18:1 in the Fair Sentencing Act of 2010, but it must be finally eliminated.

H.R. 51 would grant statehood to the residential areas of the current District of Columbia as the State of Washington, Douglass Commonwealth. The bill outlines a process to elect two senators and one representative for the new state. It sets the state’s physical boundaries and the transfer of territorial, legal, and judicial jurisdiction and authorities to the new state. In addition, it defines the reduced federal territory that would remain the District of Columbia and serve as the seat of the federal government.

The Equality Act would provide LGBTQ people with explicit, comprehensive protection against discrimination under federal civil rights laws. In addition, it would update federal civil rights laws to address modern forms of discrimination, including against all women and people of color. It would do so by updating and modernizing the scope of public spaces and services covered under the law, as well as expanding protections from sex discrimination in public spaces and services and in taxpayer-funded programs.

Description

For only the third time in its 100-year history, the ACLU urged the impeachment of a president. The ACLU National Board of Directors adopted by unanimous vote a resolution to support impeachment of President Donald J. Trump, concluding he committed impeachable offenses and violated his oath to preserve, protect, and defend the Constitution. The board concluded President Trump engaged in an extended pattern of bad-faith conduct designed to subvert and undermine the legitimacy of the results of the 2020 election by repeatedly making knowingly-false statements about voter fraud, pressuring election officials in several states to interfere with the election results, seeking to disenfranchise people of color by targeting jurisdictions with predominantly Black or Brown populations, directing Vice President Pence to block Congress' certification of the Electoral College results, and urging an unruly mob to riot at the U.S. Capitol on Jan. 6, 2021 in an effort to prevent the certification of the Electoral College results and intimidate members of Congress from carrying out their constitutional duties. Previously, the board resolved on Dec. 19, 2019 that President Trump committed impeachable offenses and violated his oath to preserve, protect, and advance the Constitution.

The effort by some members of Congress to overrule certain states’ certified 2020 presidential election results is illegitimate and based on false allegations of voter fraud — a trope used throughout our country’s history to target the voting rights and political power of racial minorities. Despite more than 60 legal challenges that were filed to subvert the will of the people, the courts, federal and state, were unanimous in their rejection of these false claims. The ACLU's position is consistent with its position after the 2000 election, when it did not support efforts to block Congress from counting Florida's electoral college votes for George W. Bush, despite disagreement with the Supreme Court's decision in Bush v. Gore.
